Supreme Court orders writ to be posted at main gate of Assin North MP

The Supreme Court has ordered the writ summons be posted on the door and other vantage points, at the residence of the Member of Parliament for Assin North, James Gyakye Quayson.

The Court gave the order on Tuesday, February, 22 2022, following the MP’s failure to make himself available to be served.

The court also directed the plaintiff to publish the writ in the newspapers with the hope that after seven days the MP would come across it.

Lawyer for Micheal Ankomah Nimfah, Frank Davies told the seven-member panel presided over by Jones Doste that, all attempts to serve the MP have proven futile and therefore, prayed that the last method which is the substituted service, should be granted.

The court granted the appeal as his lawyer, Tsatus Tsikata w,as nowhere to be found.

The Assin North MP is currently facing charges including forgery and perjury. He is also accused of deceiving a public officer and knowingly making a false declaration.

A resident of the constituency, Michael Ankomah Nimfah, who initiated the action against the MP at the High Court, has sought the intervention of the Supreme Court to stop the MP from performing Parliamentary duties.

In July 2021, the High Court annulled the Assin North Parliamentary elections saying Mr Quayson was not eligible to contest the polls.

Mr Quayson has since been legally fighting to set this aside with the matter currently pending at the Court of Appeal.
