Lawyer cries foul over Lands Commission registration error

A US-based solicitor, Roberta Ama Anokye, is beside herself with uttermost disgust following the alleged resale of parcels of lands she legally acquired at Otano, Adjiringano, some 22 years ago.

To the legal practitioner, her family and her have been under intense tautness due to the alleged criminal activities of Dr Harry Kpornu-Dawson and his gang involving the police, lawyer John Jerry Asiedu, former Tema High Court Judge Emmanuel Ankamah, Lands Commission, among others.

She said her uncle-Mr Sam Atakorah and her bought two plots of land each in 2001 from Buildaf Limited and immediately took possession of the land, built a full size wall to protect and demarcate the boundary and later built a single room dwelling on the land amd placed a paid caretaker on the land.

The legal brain pointed out that she started her land registration process and completed with land title certificate.

” …My uncle sold two plots to two individuals, and it was at this transfer stage in 2019, it was discovered that the Land Registry at my title stage made an error on the Cadastral plan and swapped my land with my plot parcel no.8376. Block plot 6 section situate at Otano on the Land Registry Map,” said the solicitor.

She added “I immediately made an attempt to resolve the issue , the Land Registry been trying to find my record/ docket with them for some strange reasons to date .

” The error by the Land Registry is what Spedee Empire Limited, a fictitious company formed by Dr Harry Kpornu-Dawson, his foreman by name Francis Tetteh and cohorts are fraudulently using as their so called legitimate claim to the land I have occupied and have peacefully enjoyed for 22:years .

“Land Registry commission have colluded with them to geduster my same registered land to Spedee Empire Limited. I wrote to the Director of Lands Commission -Miss Yaa Boadi on September 1, 2022, and visited them same year where it was confirmed in a meeting with the head of technical department of their mistake, but they have failed to officially write back to me.”

She stated that”Interestingly, the Land was acquired twice by my grantors Buidaf Limited firstly, from this same Akwraboye Doku family of Teshie and was witnessed by same ADJEI MIKE in 1999 then subsequently by the Family head Seth Laryea Mensah Ashong of Mlitse family of the Odaitei Tae We family of Teshie who at the time also had a Court Order and were the Superior Title holders of the same said Land and was by an arrangement by the same Akwraboye Doku family led by Adjei Mike, arranged to sign another indenture for my grantor, therefore, the Akwraboye Doku family by obtaining a Court Order does not have right to the same Land they had already sold and we have occupied for over 22 years, left alone to resell it. Resale of Land of any kind is fraudulent under the Laws of Ghana and the legitimacy of this transaction should be investigated, questioned and examined by the Police, Adjei Mike has confessed that he visited the land and met my caretaker in 2021 just before his demise.

“Spedee empire Ltd a company incorporated in 2019, is claiming its directors bought the same land in 2015, with a backdated indenture stamped at the high court in 2020 and lodged at the land registry and registered in 2022 but was never put to possession of the said Land, until appearing and knocking on the gate for the first time and precisely on the 18th of July 2022, and the next day the 19th they came back broke my gate along with my solid pillar fences and forced their way into my Land with Thugs threatening my new care taker to hand over my keys to them or what happened to the first caretaker will happen to him too. They then gathered all my belongings, along with my caretakers and set everything on fire and took over the land. Imagine this, in today modern Ghana”

And expressing grave worry, she said “My biggest concern is that my caretaker James in November 2021 was found unconscious stark naked in his vomit and faeces in the late morning, the gate to the land and his door were unlocked.

“We rushed him to Noguchi Memorial Institute for Medical Research, where we were told a scan revealed bleeding in his brain and he sadly died a week later in the hospital, to which I am overwhelmed with grief.

“Unfortunately, James could not live to tell his story, and I fear these same people, who threatened my current caretaker to leave the land and hand over my keys might be responsible for what happened to James.

“They have driven out my caretaker and have built a house on 1/4 portion of the land within 6 weeks and one of the wives of Dr Dawson has taken possession of the house and left 3/4 portion of the land.

“We challenged them and brought in new caretakers; Dr Dawson got them arrested for contempt of court, as they come with an injunction they had all along from Judge Ankamah, that I knew nothing about and was never served in the first place, with falsified claims against me, fabricated stories to describe what they were rather doing and maligned my good name as a lawyer, such as they rather occupied the land and I had forced my way in with land guards to disturb their peaceful enjoyment of their land, made claims that I had beaten them up and so many lies when I was not even in the country.”

She stated “My lawyers defended and challenged the injunction, before the same judge Ankamah at the Tema High Court to injunct both parties until after the substantive hearing and he refused and said it would be unfair to do so rather for the thieves and trespassers as he ordered them in the first place. Really on my land?

“Fortunately judge Ankamah left Tema High Court and we are now making progress hopefully to trial soon. We were able to stop them, and the idea is for all parties to refrain from any development of the land until the substantive hearing to determine the rightful owners.

” I am a law-abiding practicing solicitor and have acted with the utmost decorum, that the dignity of the court is to be respected and always maintained, despite that, this thug Dr Dawson is unbounded and must be stopped.

“On Saturday the 13th of July 2024 DR. has returned to demolish my walls and has removed my gate, without a DEMOLISHING ORDER and has rebuilt a tall wall and gate with the plan to develop the rest of the land discreetly.

“DR DAWSON refused to stop building when the police were called and continue to build as I write this statement.

From all indications, Dr Dawson and lawyer John Jerry Asiedu allegedly falsified and misled the courts by purporting that I was rather doing the criminal acts, they were carrying out, for instance harassing them on their land, me attacking them with my land guards etc
That is unacceptable for me, as that can affect my impeccable career as a solicitor.

Until heads of institutions like the Lands Commission Director and head of legal be called to order and made accountable, innocent citizens will continue to suffer and anarchy will be the norm.

“Indications are also that Abubaker Nuhu was the one that allegedly signed the Title Certificate for Spedee Empire Limited without any due diligence, and how did he satisfy the usual requisitions that would have been raised in such a case,?” she added.
