Supreme Court strikes out application preventing Mahama from acting on CJ removal petition

The Supreme Court has struck out an injunction application filed by the Member of Parliament for Old Tafo, Vincent Ekow Assafuah, which sought to prevent President John Dramani Mahama from forwarding a petition for the removal of Chief Justice Gertrude Sackey Torkornoo to the Council of State.

The application aimed to stop the President from initiating the constitutional procedure outlined in Article 146 of the 1992 Constitution, which mandates that any petition for the removal of a Chief Justice must first be referred to the Council of State for advice.

However, the Supreme Court struck out the case after Mr. Assafuah’s lawyer, former Attorney General Godfred Yeboah Dame, formally withdrew the suit during proceedings on Tuesday, May 6, 2025.

The full reason for the dismissal will be made on May 12.
