The Tema High Court has dismissed a habeas corpus application by Oliver Mawuse Barker-Vormawor, who has been charged with treason felony and is currently in police custody.
The legal team for Barker-Vormawor led by Professor Raymond Atuguba, filed a habeas corpus application at the Tema High Court for the Inspector General of Police (IGP) and the Attorney-General to appear before the court, to justify the continued detention of Barker-Vormawor.
But the Tema High Court, presided over by Justice Daniel Mensah held that the application for habeas corpus had failed so far as there has been an intervening event of Barker-Vormawor being presented before a District Court of which a bail application had been refused.
A habeas corpus is a writ requiring a person under arrest to be brought before a judge or into court, especially to secure the person’s release unless lawful grounds are shown for their detention.
The #FixTheCountry convenor was arrested on grounds that he was threatening to plot a coup should government pass the e-levy bill.
Members of the Movement earlier alleged that their convenor couldn’t be found after his arrest, a claim the police service refuted.
Mr. Barker-Vormawor subsequently went on a hunger strike in order to protest what they term as a ‘false democracy’.
