Supreme Court’s decision on vacant seats ‘unfair’ – Namoale

Former National Democratic Congress (NDC) Member of Parliament for La-Dedekotopon, Nii Amassah Namoale, has criticized the Supreme Court for ruling that the Speaker of Parliament’s decision to declare some four seats in the House vacant ‘unconstitutional’.

According to him, the Supreme Court of Ghana is exercising its power capriciously as it failed to consider the spirt of the Constitution in its rulings.

“The Supreme Court did not take the spirit and purpose of the 1992 Constitution into account when introducing Articles 97, 1(g), and (h),” he said.

He noted that when the Supreme Court speaks, whether right or wrong, it is their authority, but he believes that, they act without clear reason, which they should not do.

Speaking on the Angel Morning Show on November 13, 2024, Namoale stated that he was not surprised by the Supreme Court’s judgement.

He argued that under Article 99 of the 1992 Constitution, the Supreme Court should have declined jurisdiction when Majority Leader Afenyo Markin filed the case before it.

He added, that the Supreme Court has the authority to interpret and rule on any matter that comes before it but not ought to misuse their power.
