Private Legal Practitioner and Lead Editor of The Law Platform, Jonathan O. Asare, has asserted that President John Dramani Mahama is politicizing Ghana’s judicial body.
In his submission on Angel Television’s Yen Man Ghana Show, hosted by Dr. Kwame Asah on March 1, 2025, he asserted that the Supreme Court has clearly stated that the government cannot force any employees to go on leave. Therefore, he does not understand why the current government is terminating appointments and creating unemployment.
He pointed out that the President of Ghana is politicizing the judiciary, which has led the Supreme Court not to take any action against the current administration for revoking people’s appointments, a decision he deemed illegal.
He expressed that if a person’s appointment letter predates January 7, meaning the person is yet to be on payroll, the government should not revoke their job offer.
According to him, Ghanaians are unhappy that this issue was not mentioned in his State of the Nation Address (SONA).
“The CDD versus Attorney General’s case, that is the Domelevo case, where the Supreme Court made it clear that when it comes to leave, you can’t force the employee to go on leave, how much more someone who is working, someone who has been offered a job, who is yet to be on payroll, then you deny them the offer. The president is politicizing the judiciary” he said.
He concluded that the Domelevo case clearly indicates that Ghana’s judicial body has been politicized however, the law does not grant the president the authority to revoke people’s appointments, which he considers illegal.
