Aspirant seeks injunction against poll

The Action Peoples Party (APP) and its parliamentary candidate, David Ankomah, have initiated legal proceedings at the Accra High Court to stop the Electoral Commission (EC) from conducting the Akwatia by-election slated for September.

According to the APP, Mr. Ankomah was lawfully nominated as their candidate but was unjustly disqualified by the EC, despite fulfilling all necessary requirements, including providing a valid tax clearance certificate.

The legal action, filed on Friday, August 22, seeks a court directive compelling the EC to reinstate Mr. Ankomah’s name on the ballot.

The plaintiffs argue that the EC’s decision to omit him constitutes “a wrongful administrative decision actuated by malice and fraud.”

“The Plaintiffs say the conduct of the Defendant as specified in paragraphs 23 and 24 supra smacks of malice and fraud calculated to deny the 2nd Plaintiff the right to participate in the bye-election.

“The Plaintiffs say they have made several verbal protests to the Defendant to do the needful but to no avail,” reads part of the pleading statement.

As part of their demands, the plaintiffs are seeking an injunction to prevent the EC from excluding Mr. Ankomah from the ballot, along with a permanent order barring any actions they believe could harm his candidacy or the party’s interests.
