A Tarkwa High Court has ordered the Minerals Commission and the Tarkwa Nsuaem Municipal Assembly, to refrain from taking any action in relation to a mining concession operated by Tarsk Mining Limited.

The judge, John Ekow Mensah, made the declaration on November 15, 2021 on the back of a motion the plaintiff (Tarsk Mining Limited) had filed seeking for an interlocutory Injunction to be served on the Minerals Commission and the Assembly.

The latter who are the defendants in the case were on July 26, 2021 accused of seizing the plaintiff’s mining concession located at Akoon in the Tarkwa Nsuaem Municipality of the Western Region.

Responding to the suit, the Minerals Commission argued that the plaintiff was illegally engaging Chinese Immigrants in their mining operations.

According to the Commission, the Chinese nationals numbering about eight were working with expired permits at the mining site which was in contravention with section 8 (1) (a) of the Minerals and Mining Act 2006 (Act 703) and section 5 (a) of its amended act 2019 (Act 995).

But the court in its declaration, stated that the agents, workmen and all who claim through the Minerals Commission and the Tarkwa Nsuaem Municipal Assembly, are restricted until the final determination of the suit.
