Court dismisses Bernard Mornah’s suit against EC

An Accra High Court has dismissed an application filed by the flagbearer of the People’s National Convention (PNC), Bernard Mornah, challenging the Electoral Commission’s (EC) decision to disqualify him from the upcoming presidential elections.

The court’s ruling, delivered on Monday, October 21, rejected Mornah’s attempt to overturn his disqualification by the EC.

Mr Mornah sought a declaration that the decision by the first respondent, Jean Mensa, and the second respondent, the EC, to disqualify him without providing specific grounds or affording him an opportunity to be heard was a violation of his right to due process.

He further requested the court to declare that the respondents failed to follow the proper legal procedures, as they did not communicate the exact reasons for his disqualification nor give him a chance to address them.

He argued that the actions of the respondents were unreasonable, unfair, and violated Articles 23 and 296 of the 1992 Constitution.

Mr Mornah also called for the court to quash the EC’s decision, made on September 20, 2024, to disqualify him from the 2024 Presidential Elections.

The EC, in a press release on September 20, had cleared 13 candidates to contest the December polls, while disqualifying 11, including Bernard Mornah.
