Suspended NDC Secretary gives National Executives 3-day ultimatum to reverse suspension

The suspension of the National Democratic Congress (NDC) Secretary for Assin Central Constituency Secretary has taken a new twist as his lawyers have issued a detailed response challenging the decision.

The suspension letter, dated July 2, 2024, and signed by the General Secretary of the NDC, Hon. Fifi Fiavi Kwetey, cited deliberate misrepresentations and criminal conduct by the Secretary as the reasons for his suspension.

The letter directed the Secretary to hand over party property and cease representing himself as the Constituency Secretary.

In a prompt and robust response, the Secretary’s legal team has refuted the allegations laid out by the Functional Executive Committee (FEC). The lawyers’ statement emphasizes that the suspension is not only unwarranted but also procedurally flawed as they argue that the actions attributed to their client, including the purported misrepresentations regarding the parliamentary candidate’s withdrawal, are baseless and have not been substantiated by any concrete evidence.

The lawyers further contend that the suspension violates their client’s right to fair hearing and due process as enshrined in the NDC’s own constitution. They underscore that their client was not given an opportunity to present his side of the story before the suspension was handed down, which they claim is a clear breach of natural justice principles.

Additionally, the legal team has highlighted that the referral of the Secretary’s conduct to the National Disciplinary Committee for further investigation does not justify an immediate suspension. They assert that any punitive measures should only be considered post-investigation, following the establishment of actual wrongdoing.

The Secretary’s lawyers have called for the immediate reversal of the suspension and a full investigation into the matter, assuring that their client is prepared to cooperate fully with any legitimate inquiry. This response has cast a spotlight on the internal dynamics of the NDC and raised questions about the processes and governance within the party.
