James Gyakye Quayson: Supreme Court’s ruling has denied Assin North representation in parliament – Amaliba

A member of the legal team of the National Democratic Congress (NDC), Abraham Amaliba, has said that the injunction placed on Member of Parliament (MP) for Assin North, James Gyekye Quayson, has denied the people of Assin North Constituency a representation in Parliament.

In a majority decision of 5-2 by justices of the Supreme Court, the court ruled that Mr. Gyekye Quason cannot perform duties of a lawmaker in Ghana’s Parliament.

The 7-member panel saw Justices Agnes Dordzie and Nene Amegatcher dissenting while Prof. Henrietta Mensah Bonsu, Mariama Owusu, Gertrude Torkornoo, and Emmanuel Yonny Kulendi were in favour.

“The people of Assin North have been denied a representation in Parliament and that is not democracy”, Mr. Amaliba contended in a TV3 interview.

Speaking further on the subject, he declared that “we are weighing our options, we are meeting today to determine the next line of action.”

While, Baba Jamal, a member of James Gyakye Quayson’s legal team, has disagreed with the Supreme Court’s ruling on the Assin North Constituency election petition, the Attorney General, Mr Godfred Dame has said that Mr James Gyekye Quayson must suffer the fate of former New Patriotic Party (NPP) MP for Bawku Adamu Dramani Sakande.

Mr. Sakende was sentenced for two years imprisonment after he was found guilty of false declaration of office, perjury and deceiving a public officer when he contested the Bawku seat even though he had not conclusively denounced his UK Citizenship.

Mr. Dame stated that ”there ought to be an equal application of the law, the same fate that befell Adamu Sakande who was not qualified at the time that nominations were opened and we all know what happened to him. Subsequently, they declared him ineligible and his seat was taken away so there ought to be even application of the law.”
