Former MP Ras Mubarak sues MTN for $5 million over service failure

Former Member of Parliament (MP) for Kumbungu, Ras Mubarak, has filed a lawsuit at the High Court against Mobile Telecommunications Network giant (MTN) Ghana.

He is seeking a $5 million compensation for what he described as damages caused by MTN for their inability to deliver reliable services during a business trip outside the country.

The outspoken politician who filed the lawsuit on November 27, 2024, said sometime in September, he embarked on a business trip to the United Arab Emirates, Bahrain, Turkey, and Saudi Arabia with the activation of a roaming service from the MTN.

He noted that upon his arrival at his first destination, he discovered that there was no access to the usage of the network he had activated after several attempts, however.

According to him, “he made several complaints to the MTN customer service team, but his complaints went unattended to, leaving him stranded for one whole week without a mobile network connection.”

The dire consequences, he stated, made it impossible for him to receive calls, send or receive SMS, and access internet data service.

These, the plaintiff stated caused him immeasurable damage to his business following the failure of the mobile Telecommunication network to resolve the matter.

Among other reasons, Ras Mubarak is seeking compensation from MTN Ghana of the following;

Firstly, he is demanding $ 1 million as damages for a break of a service contract as well as $4 million for hardship, inconvenience, and reputational injury.

The plaintiff is also demanding interest on the amount awarded at commercial bank lending rates from the dàte of judgment until the date of final payment.

“The payment of costs of this action on a full indemnity basis, including Attorneys legal fees,” stated further by the plaintiff.
