Majority Leader Mahama Ayariga and his Chief Whip, Rockson-Nelson Dafeamekpor, have reportedly drafted a private member’s bill to repeal the OSP Act and abolish the Office of the Special Prosecutor.
In a memorandum accompanying the bill sighted bt this portal, cites Article 88 of the Constitution, which vests prosecutorial authority in the Attorney-General, as the legal basis for the proposed repeal.
It argues that the creation of the Office of the Special Prosecutor in 2017 introduced duplication of prosecutorial functions, institutional friction, and jurisdictional overlap, resulting in delays and inefficiencies.
According to the drafters, the Office of the Special Prosecutor has incurred high operational costs with limited demonstrable impact relative to its budgetary allocations.
The memorandum also highlights fragmentation in national prosecutorial policy and challenges in sustaining long-term institutional capacity due to parallel administrative infrastructure.
The bill proposes that the anti-corruption prosecutorial mandate be exercised through a restructured Office of the Attorney-General and Ministry of Justice, featuring a specialized anti-corruption division.
This, it argues, would enhance efficiency, accountability, coordination, and prudent use of public resources.
